General News: Customers Say Local Store Duped Them

A new store on Main Street in Cornwall is the target of complaints made this holiday season by several shoppers who say they paid for items they never received. The subject of their complaint is the iStore, which  opened in October, offering accessories and service on Apple Ipod and other phone and computer products.

In the past week, at least four people have complained to the Cornwall police about the store and officers were called to the scene last Tuesday when an irate customer allegedly threw a chair at the storeowner, Tim Richard.

Maggie Halliday said she took her daughter’s MacBook to the store for repair in November. After two weeks, storeowner Richard, said he couldn’t fix it and offered her a chance to buy one “at cost,” just $600. The offer was so good she decided to surprise her other daughter with a MacBook for Christmas, too, and paid Richard $1,300 in cash for the two computers and accessory items.

Halliday said that she was told that the computers would arrive in two days. After repeated visits to the store, Halliday said she received one computer, only to discover that it was her daughter’s original computer, but with a different hard drive that was four years old. She demanded her money back and on December 18th Richard wrote her a check, postdated to December 27th. When she tried to cash it, the check bounced and she went to the police.

Stephanie Cohen had a similar experience when she ordered a MacBook Pro for her son in November. She said when her son examined the machine, it did not meet the specifications, showed signs of wear and had a hard disk dating from 2001. When she called Apple to check the serial number, Cohen was told that the computer had been sold last May, then sold again later in the year. They didn’t know how it ended up at the iStore. Cohen said she was lucky because she paid for the $2,700 computer with a credit card and would be refunded for her loss.

Another customer who is unidentified said he never received the Ipod he paid for in November and that every time he goes to the store, it is closed.

Reached by phone on Monday, Richard said he had no comment about the allegations made by disgruntled customers.

However, on Tuesday morning he met with Cornwall police chief Todd Hazard who said that Richard turned over some equipment that had been left for repair at his shop to return to the customers, along with money for an Ipod that had never been delivered. “He seemed to want to make good with everyone affected,” Hazard said.

Chief Hazard cautioned that sometimes it is hard to make criminal cases in situations like this, noting that if you postdate a check you can’t be charged with passing a bad check because the recipient took the check knowing there were not enough funds to cover it. He said also noted that Richard plans to pursue charges against the individual who allegedly threw a chair at him last week.

Steve Jobs' lawyers would have been all over this guy like white on rice if they knew he'd named a store i-Anything, just as McDonalds sues you if you try to name your dental clinic Macdental or your bookstore Maclibrary.

As far as I know, you can't buy a legitimate, factory-new Apple product of any sort from anybody but an Apple store, and they all have no-dicker stickers. Apple doesn't discount anything.

I would like to add, that as well as "duping" its customers, the iStore has also duped its employees in that is has not paid anyone who worked there essentially since it opened. Myself included.

The above comments just shows the moral condition of today's world. Those who do wrong, get the benefit of the doubt,while victims must "prove" their case. This store and its owner is clearly engaging in fraudlent activity. What's NOT criminal about that?

It's really a shame that this happened in this community. It's very hard for small business to make it these days, and to have something like this happen in Cornwall is terrible. I am sure that other retail business owners would agree with me. I really hope that everyone gets either their money or product back.

Ms. Rhodes, the presumption of innocence has been part of Western jurisprudence for centuries. It is not some new notion in "today's world." Although it is not explicitly guaranteed in our Constitution, it is implied by various amendments and was established explicitly by the Supreme Court decision in Coffin v United States in 1895. It's not something to be tossed out lightly.

I have a mac that was no longer covered by a service agreement ... the Apple store in the Palisades mall told me to go to a place called TechSmith in Newpaltz ... They are certified by Apple to work on Apple products ... If you call Apple and live in Cornwall they will give you a choice of two Mac certified places to go, one in Westchester and the place in Newplatz ..

I was fixing iPods and iPhones for this store since the middle of November. I have yet to be paid and I have a number of bad stories about this Tim Richards that would only make a lot more people angry. Been waiting to be paid for over a month now. I was very happy to be able to be able to fix some peoples ipods and phones, to those who didn't get theirs fixed it was because Tim never ordered the parts he claimed he did, and continually lied about when the package was coming, I can't fix anything without the right tools. God only knows where everyone's money went... I recommend those who got screwed over don't back down. If you shopped at the iStore, that means you were screwed over no matter what, trust me. Does anybody have any suggestions on how to get my ipod that I dropped off at the store over a month ago back? I am filing a stolen property report with the police but any other suggestions would be appreciated! Very frustrating situation!

I have seen a few incidents like this with some small businesses that are just starting up. From what I have read here, it seems like Mr. Tim Richard took advantage of a lot of people. It is important for the individuals who were victimized to follow up. Any poor business practice or fraudulent activity of this magnitude should be reported. The important thing is to guarantee that no else be victimized by Mr. Tim Richard or by any other business owner for that matter.

I was personally a business partner with Tim Richard for over 6 months luckly i had the buisness accounts in my name for our prior website IPHONESTORE.COM he is a fraud and i was lucky enough to close all accounts and walk away with over $10,000
which royally pissed him off hahaha so he has been screwed over as well!!! Altho he owes me a lot more money than that with this happening it helps my case a whole lot more because we never had anything on paper!!!!!! For all past employees please show up for the meeting scheduled by the editor so we can go over the situation!!!! Thank you

I'm guessing Ms. Shearson was not a victim of Tim Richard or she might be less inclined to school us on his constitutional rights. I was also ripped off by Tim Richard, so I have no doubt as to whether or not he is guilty of deceptive business practices. A businessman who sincerely wants "to make good" doesn't wait to do so until after local authorities get involved and then makes himself scarce when looking to be found. I've already called my credit card company to dispute the charge and I plan to call the numbers posted here. I recommend everyone who was ripped off do likewise. There's strength in numbers. He screwed up his buisness in washingtonville that was in the back room of the jennie tomkins law office, now he screwed up in cornwall, he will probably move back to new jersey with mommy and daddy and try and start another buisness out there with a different name!!! Im sending this article to his parents so they can see their son isn't as innocent as they think he is!!!

To further up on my previous comment, if you have purchased any Apple brand products from Mr. Tim Richard at the iStore such as iPods or iPads, you should have it certified by Apple. You may have unknowingly purchased stolen or fradulent Apple branded products.

What about the Chamber of Commerce. Has anyone from this organization helped the consumers or offered guidance. Perhaps the strength in numbers should also come from other businesses to bring new business to Cornwall. Perhaps it is time to allow chain stores to come to main street. they do it very eloquently in other towns and can finally make Cornwall - Main Street Vibrant again. IT should be more like Nyack, Piermont and Cold Spring - There I said it now all you old timers can ream me.

I?m neither an old timer, nor do I have any interest in reaming you. You?ve asked about the Chamber of Commerce, not for the first time. Yes, more than one of our members has attempted to assist in putting folks in touch with Mr. Richard. Is there something specific you expect of the Chamber? The Chamber has neither legal nor enforcement powers. I posted a link to the Attorney General?s consumer affairs division previously. This is the office charged with dealing with consumer fraud.
